This End‑User License Agreement (“EULA”) applies to all AVNX products and services (“Products”), whether free or paid, distributed through Air Manager and the Sim Innovations BV website. By downloading, installing, or using any AVNX Product, you agree to this EULA.
1. LICENSE GRANT
AVNX grants you (“Licensee”) a non‑exclusive, non‑transferable, revocable license to install and use the products on one or more devices for personal, non‑commercial use only. This license does not transfer ownership.
2. INTELLECTUAL PROPERTY
All products, including source code, graphics, and media, are the intellectual property of AVNX and protected under copyright and related laws. All rights not expressly granted are reserved. You must retain all copyright notices.
3. RESTRICTIONS
You may not:
reverse engineer, decompile, or disassemble the products (except where legally required for interoperability);
use reverse engineering to bypass licensing or create competing products;
redistribute, resell, lease, sublicense, or transfer the products;
upload, publish, or share modified versions;
use the products for commercial, professional, or revenue‑generating activities.
4. BRANDING AND QUALITY PROTECTION
You may not use the AVNX name, logo, or trademarks to brand or distribute any product, including modified versions, that is not an official AVNX release. Distribution of modified versions is strictly prohibited.
5. SOURCE CODE & GRAPHICS
Source code may be provided in unencrypted form for personal use only. You may view and modify the code privately, but you may not publish or distribute modified versions or reuse the code in other projects. Graphics and media may be visible or unprotected, but their use is restricted to what this EULA permits.
6. DISTRIBUTION
All AVNX Products, free and paid, are distributed exclusively through:
Air Manager
Sim Innovations BV (for paid products)
All purchases, payments, refunds, and account handling are governed by Sim Innovations BV’s Terms of Use. AVNX does not process payments or customer financial data.
7. WARRANTY DISCLAIMER
Products are provided “as is” and “as available”, without any warranty. AVNX disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, and non‑infringement. AVNX does not guarantee uninterrupted operation or error‑free performance. This disclaimer does not limit rights granted under Belgian or EU consumer protection law.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by Belgian and EU law, AVNX shall not be liable for any damages, including direct, indirect, incidental, special, or consequential damages, arising from use or inability to use the products.
9. STREAMING AND CONTENT CREATION
You may display AVNX Products in publicly available content such as livestreams, videos, and other digital media. You may monetize such content through ads, subscriptions, donations, or similar methods. Attribution to AVNX is requested where reasonably possible. This permission applies only to content creation and does not grant broader commercial rights.
10. TERMINATION
This EULA remains effective until terminated. Your rights terminate automatically if you violate any terms. Upon termination, you must stop using the products and delete all copies.
11. GOVERNING LAW
This EULA is governed by Belgian law. Any disputes shall be resolved exclusively in Belgian courts.
12. AMENDMENTS
AVNX may update this EULA at any time. Changes take effect upon publication on the AVNX website. Continued use of the products constitutes acceptance of the updated terms.
